The point is, doing that turned it from murder to a very possible self defense scenario. Same as Michael Brown and Trayvon Martin. Whether they shouldve gone out there to confront someone is kinda irrelevant. They saw someone matching the description of an earlier theft doing sketchy shit. That person had stolen a 9mm handgun (havent confirmed this from multiple sources). Believing the man might be armed, they brought gun, and tried to stop the man. Man fights younger dude for the shotgun, gets shot in the hand. Continues fighting and is shot again in the struggle. Continues fighting and (i believe) McDaniel finally gets co trol of the gun and shoots him once in the chest, ending the fight.
I mean I understand but how can we decide "a normal person at that range of having a gun pointed at them would run away?" That seems just as stupid, as though you're gonna somehow run away from a bullet. Both seem like spur of the moment instinct shit- fight or flight.
And I mean this isn't even a police type scenario where it's a dude getting drawn on by actual law enforcement, it's just a dude who sees dudes in a truck coming at him with a gun. You wanna be the judge and jury to say "oh well yes he clearly should've ran away and since he instead lunged at the gun he was the real threat and not the guy confronting him with the gun in the first place"?

Yeah for sure different states definitely have different guidelines. I think around here if you did that the worse you would get charged with is criminal trespassing.
