no one is supposed to be living in a warehouse but if someone was caught wandering around in one who didnt belong theyd still be charged with burglary.

A car is indeed a dwelling as one can be charged w/ "maintaining a dwelling for controlled substance" yadda,yadda for having dope stored in the car. In criminal law, dwelling means a building or part of a building, a tent, a mobile home, or another enclosed space that is used or intended for use as a human habitation.
A good lawyer will point out it was not enclosed as it was under construction. But you can trespass into burglary w/no breaking & entry. Either or, kid was caught & decided to bail then played dummy & got his dummy prize. Darwin was no fool. -
