irrelevant. the presence inside a home is sufficient probable cause to indict on burglary.

Defense is going to argue these guys had good reason to believe this was the same suspect and that he was armed. Theyre going to say the weapons were legally owned and not brandished, that the older man didn’t even draw his weapon until shots were fired, indicating they did not expect that they would have to fire their weapons. Theyre going to say Arberys attack is what caused the first and second shots to go off, and that as soon as he had partial controlof the weapon he became a deadly threat.

They should win as well. but w/ the fucking media's "jogging" narrative & idiots like Technologist online, they'll likely feel pressured & go w/ "negligent manslaughter" definitely not murder though. -

Open carry and citizens arrest are legal in Georgia and judging by the video they had guns but didn't even point them at the jogger until he charged them down.
He had the option to talk to them or to run away, but he thought he could beat buckshot with fists apparently. -

Citizens arrest is only legal if you witnessed the crime, or have intimate knowledge of the crime. The yahoos have neither.
I’ve gotta say, I have no idea what I’d do if I saw two yahoos with guns, knowing how blacks can be treated by people just like finney.
I don’t understand running away, there’s nowhere to hide and the father yahoo has a heightened shot site. -

He could have very well been jogging but he attacked them. Everything prior isn't really relevant in self defense. Their reason for approaching him may have been wrong but so was attacking them -

Trespassing is a crime, as well having a firearm stolen from a car in front of their residence on a an earlier date by someone fitting his description. One's a retired LEO, I'm pretty sure he knew the protocol lol. -

In criminal law, dwelling means a building or part of a building, a tent, a mobile home, or another enclosed space that is used or intended for use as a human habitation.
A good lawyer will point out it was not enclosed as it was under construction. But you can trespass into burglary w/no breaking & entry. Either or, kid was caught & decided to bail then played dummy & got his dummy prize. Darwin was no fool. -

a car isnt considered a dwelling but there is a crime of 'vehicular burglary'
no one is supposed to be living in a warehouse but if someone was caught wandering around in one who didnt belong theyd still be charged with burglary.
homeless niggers where i live have been arrested for 'vehicular burglary' when the occupant of the vehicle was giving the homeless beggar money because literally just the beggars hand entered the vehicle. -
