Defense is going to argue these guys had good reason to believe this was the same suspect and that he was armed. Theyre going to say the weapons were legally owned and not brandished, that the older man didn’t even draw his weapon until shots were fired, indicating they did not expect that they would have to fire their weapons. Theyre going to say Arberys attack is what caused the first and second shots to go off, and that as soon as he had partial controlof the weapon he became a deadly threat.

Robberies in the area
Gun is stolen from McMichaels truck.
Black male seen on camera in construction site
Neighbors on look out for young black male 25-30 years, 150-180 lb.
Neighbor sees black male enter same co struction site, calls police.
Male comes out, sees caller, begins running
Considering suspect might have the same stolen gun, McMichaels bring weapons
Ill advisedly follow suspect.
Park car up block from suspect to keep him from getting away. The elder McMichael in the truck bed, weapon holstered, and the younger to the left of the truck, shotgun at his side.
As suspect approaches, yell something to the effect of “ WE WANT A WORD WITHH YOU. HEY STOP!”
Suspect crosses from the clear right side of the vehicle, to the front left where TM is standing, runs at younger mcmichael, begins wrestling for the shotgun, and strikes McMichael.
Arbery is shot in the hand with which he is holding the barrel.
Struggle for the gun continues. Arbery continues to punch McMichael.
Shotgun is fired again at an upward angle, striking Arbery in the torso
Fight continues, With TM apparently firing a last shot at Arberys chest, after which he briefly continues fighting, stumbles off and dies.
Notice i dont say anything about tools or water or whatever because i still have t seen anything concrete on that yet. -

Especially if thise things are two blocks away like the parties were when the video began. If theyd come out of nowhere, id understand it more. If theyd shot him before he made contact, id understand it more. I couldnt even see if the weapon was aimed. The father in the truck certainly didnt have a weapon drawn. He seemed to know that someone had called the cops. He saw and heard the neighbor on the phone, and thats why he started running. He could see the truck parked blocks ahead of him. He couldve continued running straight. Or left. Or SERPENTINE. But for some reason he went straight for the guy with the gun. And not only went to CONTROL the gun but started punching the dude in the face.

To say well, I pulled a gun on this guy and he reached for it and tried to grab it so I shot him because I was scared for my life.
Ass backwards.
Reaching range, maybe. Anything else and i think any normal person is just gonna get behind something or run away. The point is, doing that turned it from murder to a very possible self defense scenario. Same as Michael Brown and Trayvon Martin. Whether they shouldve gone out there to confront someone is kinda irrelevant. They saw someone matching the description of an earlier theft doing sketchy shit. That person had stolen a 9mm handgun (havent confirmed this from multiple sources). Believing the man might be armed, they brought gun, and tried to stop the man. Man fights younger dude for the shotgun, gets shot in the hand. Continues fighting and is shot again in the struggle. Continues fighting and (i believe) McDaniel finally gets co trol of the gun and shoots him once in the chest, ending the fight.
