You download a packet, which gets stored in the cache. It's not the actual file. It doesn't 'get stored on your hard drive.' The cache is easy to clear and can be faked, so they don't use it at evidence. They'll look at your ISP's data for that. It's more reliable than looking at your device.
Your ISP also knows how long you looked at something and where you accessed it. It's important to note that the charge is POSESSION of child porn, not VIEWING child porn. If you don't download it intentionally, there is no crime. Otherwise you would be charged for every minor illegal thing you happen to stumble across, and that's just ridiculous. Both ethically and logistically.
