Really? Because that us exactly what my attorney did last month when he had my DUI dismissed under the 4th amendment. The cops said their probable cause was a loud muffler. I had just replaced the entire exhaust from the manifold back and was able to prove it. This meant that any evidence obtained by them after the stop was inadmissible under the 4th amendment. All charges therefore had to be dismissed as the state had no evidence to prove their case. The highest law in the land (constitution) prevailed. You know nothing... -
