   Same as above, 99% of the time the unemployment office sides with the employer in a "their word against yours" situation. They have an interest in not paying.

   The amount of effort to prove that wouldn't be worth it and any intelligent judge or arbitraitor would see right through it. Secondly if he was fired after asking or receiving back pay it would be easy to prove it was retalitory. Thing I learned through the years in human resources and many arbitration cases is that the judges aren't stupid and typically don't fall for shit like this. If I was the op I would hope for them pulling this shit as it would mean a cool payday and sticking it to a shit employer
