You just don't understand that law and english are not the same language. Offensive is not what a given individual in a given situation feels it is under the law. It means what a judge or jury believes most people in society would reasonably find to be offensive. Most people would not find it reasonable to be offended by another person wearing a hat in support of a sitting US president.
