   It's the basic 'expectations of privacy'
   
   If someone is in their home or a public bathroom they expect privacy. That's why cameras are prohibited...even having criminal penalties against them.
   
   If they're in a public place they know other people are also there and whatever happens isn't private.
   
   Upskirting is in the category of public restrooms. They may be wearing a dress in a public place but there is the common sense norm that the dress covers private parts and the wearer expects no one to look up her dress
