It's going to be hard to get copyright and distribution rights for all those roms...or do you just intend to steal them and then add another felony to your growing list?

everyone else is doing it. its not a felony or a crime son just a civil matter and i plan on being as little upfront about my name and address as possible and create it via proxies. if wll those eastern europeans and russians are doing lolita porn or modeling and hakcing why csnt i at least make roms in east euro?

you think all those sites thst exist and existed for decades like coolroms have copyright agreements? even emulators like pc engine charge for downloads with no copy rights and no one ever went to jail.

Theft (of a certain $$ amount) is a felony. Stealing peoples products is theft.

"Copyright infringement is generally a civil matter, which the copyright owner must pursue in federal court. Under certain circumstances, the infringement may also constitute a criminal misdemeanor or felony, which would be prosecuted by the U.S. Department of Justice."

By selling/distributing the roms it goes beyond simply copyright infringement and becomes theft.

Most of the popular sites have been shut down and people are in jail.

its intellectual property not physical thus its only a copyright infrigment or civil law and thsts only if they can find and track you. how else do some sites still exist even past massive nintendo campaigns and media outrage like coolroms and romnation and shit?

the fbi is not gonna assist nintendo and let them use their ip tracking child porn software to find a rom site creator or even hacker. theyre not gonna waste the resources of a forensics lab for it. what surprises me though is why eastern europe and russia was so open and easily identifiable about it and still no one did anything or does as co pared to usa. i mean that ls studio was like an open company. like a regular mom and pop business wanst it for years?

Wrong. if you are profiting from someone's work then you are taking money from them...it's theft plain and simple...again most popular sites have been shut down and people ARE in jail.

Simply because others are still breaking the law or have yet to be prosecuted, brought to trial or caught doesn't equate to them being within the law.

Another example of 'non physical' theft...stealing cable TV...

"Stealing cable TV is a federal crime. The law prohibits anyone from intercepting or receiving any cable communications unless authorized by a cable operator. "

They didn't do time. You won't do jail they will ceast and desist and sue you so no matter what bank you use they can. Take every penny and they will physically seize ur servers

It's not new, it's the same as copying/selling/distributing Videos/DVDs/MP3s etc etc MANY MANY people have done time for it. You trying to justify (another) crime rather than getting an actual job doesn't change that.

yet i just downloaded nanostrsy for the ds off a simply google search and it was the first site thst popped up. so obviously they didnt shut down much nor wre now. and it wont be worth to sue me if i am not yet making good money or profiting off the site, it would cost them mroe in legal fees and to have tos end a lawyer to warsaw poland to do it since to sue someone you have to know their full name, pesel, address and go to their city of residence or business which would both be here. and theyd have to know my full name. i am thinking of signing up vis proton mail and not using my standsrd google id i use to crewte my other sites and just using weebly so they would even be able to find me without spending a shitload of money on a private investigstor anyway.

Again plenty of people have done time for counterfeiting...which distributing and selling digital media is/has been accepted as.

Regardless, it's not a legit business to be in (and no one except an idiot would pay you for them anyway...granted there are a lot of idiots in the world though).

You're one of those people who when they get stopped for speeding complains to the cop "why are you not stopping everyone else!"...aren't you.

What others do and/or get away with doesn't not legitimize your actions.
