The cops are pretty responsive here, they might not come out for a cat up a tree but if you called and said "someone is in my house or someone is on my property"...they will likely be there in less that 5 mins..because in the good ol USA many of those calls usually result in someone being shot or raped otherwise and they don't want their tardiness to be in the news.

My dad (in the UK) told me last year he got a letter from his local cops(Basingstoke) saying that they were so short staffed they would not be sending anyone out for burglaries on certain days of the week!...how fucking ridiculous is that...so they basically also said to potential burglars.."Hey you can go rob houses on Monday, Wed, Thur and Sat and you'll be fine"

In reality the cops would probably not come, and if they did they would tell me to fuck off as dealing with it's not their problem, any more than any other contractual dispute is.

And a smart squatter would just not answer and not cooperate, which is not illegal.

Contractual Dispute? There is no contract between a homeowner and some random person who decided to squat in the homeowners home/land. I'm not sure what your saying is the squatters rights, they have no rights or claim to the property just because they planted their ass there.

I think he might be in the UK...they were very "in favor of squatters rights" when I lived there, it was/is a big problem...that might have changed in the last 20yrs though. But I remember if you got a squatter in your property you were pretty much fucked and many property owners would PAY the squatter to leave as that was the only solution.

I'm glad I only visit the UK now.

EDIT: Looks like they finally criminalized squatting there too 7yrs ago.

The burden of proof is on the one making the claim. If a person is claiming they have a right to be there, they have to prove it...the owner will easily be able to, the squatter/tresspasser, not so much.

The scenario of you coming to my house/land and claiming ownership would result in your arrest...maybe not a charge but you'd be arrested and put in jail for the night, a judge would see you next morning. Not everything goes to trial either...you can get 30 days for contempt for example without an sort of a trial if you get smartassy with the judge.

I would think all the homeowner would have to do was show their deed and property papers

ETA: I don't quite get what you think the squatter rights are to the home/property. He/she has none @ Star Trek

In Poland the fops encourage you to not even report and make them do any work and threaten to jail you if you try to report something making sure you understand lying or false reporting will result in you going down. How is it in Russia Misguided Russian?

So she was arrested on a warrant, and had to wait 2 months for the prosecutor to file formal charges.

That's not the same thing as cops being able to arrest you without stating any reason.

I mentioned in my neighbors dog shooting story last week when I called the cops they said "just shoot it if it's on your property".

Does Texas have a stand your ground law Jiggy? Would it apply with a squatter?

No, she was arrested for a serious crime...the warrant was for another charge..if you have a bench warrant (a warrant from another court) you can't make bail.

She sat in county jail for 2 months while the prosecutor and defenses lawyer went back and forth trying to work out a plea deal. Thinking about it she might have been charged actually but those charges were changed after a plea deal was agreed on.

It's a bit like the impeachment thing...it's not really impeachment until it's filed, same with charges..I suppose technically she was charged but not filed yet. But again, it isn't the arresting cop who charged her. He's just the grunt doing the arresting...

Stand your ground laws just mean you don't have a duty to retreat. They are not an entitlement to go around murdering people.

Yes...IF the "squatter" proved a threat...You have the right to use reasonable force to remove them but not deadly force UNLESS they become a danger to you...well that bits easy to get around...shoot them, throw a kitchen knife a few feet away (after pressing it in their hand for the prints of course)

It is if you feel threatened...again that's pretty easy to establish and hard to dispute.
