US citizen stripped of citizenship for the crimes of a family member

    32 year old electrician with no criminal record. Immigrated from Bangladesh to the US at 8yrs old. Has a wife and three children.

    His brother detonated a pipe bomb in NY. His family was investigated and none were found to be complicit.

    Regardless, his bank account was closed, the FBI put his business license on hold, and he got a letter stating they were planning to revoke his citizenship. His mother and sisters with green cards had their resident status revoked. His mother and one sister were detained. DHS claims it is because they are not related to the uncle who helped get them into the country, and that it is unlawful.

    It should be noted that to apply for a green card through family, you already have to prove the relationship. These are the list of things you can use to prove that.

    So it's interesting that they are only now, 24 years later, after this guy has already applied for a green card AND citizenship, and got them, that they decide the documents he provided were not legal.

    This is the legislation they're accusing him of breaking.

    For a criminal conviction, the federal government must show “proof beyond a reasonable doubt” that the individual violated 18 U.S.C. § 1425 because the individual knowingly obtained or attempted to obtain naturalization through fraud for him or herself or for another individual. Denaturalization as a result of a criminal conviction is subject to a ten-year statute of limitation.

    So not only are they accusing an 8 year old of intentional fraud, but this goes well beyond the 10 year statue of limitation.

    In 2017 the Supreme court ruled in Maslenjak v. United States that you must actually break the law to be deported. The statue above is specifically cited in the court document. You cannot revoke citizenship without them breaking the law.

    In short, DHS is breaking the law and trying to punish law abiding citizens and residents for the crimes of their family members, much like Hitler did.

    I'll never get deported. Even if I committed a terrorist act or smuggled drugs. I was naturalized at birth like all natural born Americans.
