There needs to be an element of intent. For example, if an illegal alien had, say, amnesia, during their temporary stay in US, and found themselves in a predicament where they had no idea where they came from, who they were, or where they were going. Imagine they are then unwittingly snared in the Homeland Security dragnet, and find themselves unable to explain their illegalness. Not everything is as black and white as you think it is. There are always exceptions to the rules.
