Mostly recent results and then a massive gap where it slows down into only being mentioned together every few months, and now it's every other day. Very interesting.

I'm not familiar with the case, and don't want to be, but in general with GDPR it's all about personally identifiable information. Once data is anonymised so it can't be traced back to an individual you can do with it whatever you want. This is a practical necessity, because otherwise even counting how many users your site has would be impossible. -

It’s unlikely to be successful, like soy said partial or aggregate data that can’t be used to identify users is permitted. E.g. I remember the case that established ip addresses aren’t personal info unless you also have subscriber info that would allow translating those addresses into subscriber names. I don’t see a bag of model weights measuring up to that bar. Always possible the court just decides that it hates AI I guess, but it seems doubtful. -

I haven't bothered to read much about this in particular but I suspect the question is about the raw input data rather than just the model weights, and historically 'anonymised' data has been relatively easy to deanonymise if you have other external datapoints to link it to.
like how the Heritage Foundation was able to datamine Crooks - they apparently went to a mobile ad databroker and had them run a search for AD IDs that spent a lot of time at Crooks' home and work/school addresses, so even though there was no personal information in the advertising data they were fairly reliably able to link the 'anonymised' dataset to him. -
