I agree! Like I said, it's not a slam dunk. Which is why if this went to court without more evidence, it'd be one of those cases where I would highly recommend a bench trial. An honest judge would be forced to let you walk. But if there are two things I know about Americans it's that they are both retarded and obese obsessive about jury trials. Like, that is their gold standard of Fairness and Freedom.

A jury of your retarded American peers could drop the ball here, and it wouldn't surprise me if some prosecutors rely on these facts.

yeah but I mean if they know they have no chance of getting a conviction based on what they have they're not going to spend the money to go to court, just seems like they're trying to put pressure on him and he just has to say 'no sé' a lot and wait it out

My foreign Americans: Tonight I want to talk to you on a subject of deep concern to all Americans and to many people in all parts of the world - your trial options within your legal system. Having the RIGHT to trial by jury is important for fairness and freedom, this is true. But so to is it important sometimes for one to opt not to exercise that right, if they wish to actually remain free. I don't think enough people understand that. If you're innocent, can be respectful and polite to authority figures, and you aren't a political prisoner, odds are good that a judge will give you a more fair shake than 12 morons picked off the street at random. 😤

I mean yeah, probably. Sorry, I skimmed and missed this in the first post lol. I'm serious though, if I were a greasy southern prosecutor I could probably see myself thinking I could secure a conviction with that.

Why are you tryna avoid implicating yourself in other crimes at this point? It kinda doesn't matter if they've got your DNA on a murder weapon - odds are you ain't going to accidentally implicate yourself in some other, more serious crime.

People are so fucking weird about cops. Don't get me wrong: they aren't your friends and using your Miranda rights and the 5th amendment are important. But it's not like when you get arrested the correct play is always to clam up, be super uncooperative, plead innocent, and insist on a jury trial. Sometimes it's smart to plead guilty. Sometimes it's smart to be open and cooperative. Sometimes, a bench trial is a better choice.

After a certain point, the cops, prosecutor, and judge are just going to want you in jail for wasting their fucking time.

It's not a matter of will, so much as ability - I can't stop him. There have been times when I asked him to stahp because I was getting a little worried that he was too into whatever he was doing, but he is his own creature and more to the point... idk, he's seemed totally sane today.

He's fine, anyway. Just having a bit of harmless fun.

The only arguments for 9/11-related flippancy being immoral that I can see are:
    1) It'll hurt those who are traumatized. And hurting people is bad. Unless they're masochists.
    2) You've arbitrarily declared "being somber after tragedy" is virtuous.
    3) It's a widely held personal principle to treat tragic events with respect, and so you are morally obliged to not joke about them regardless of whether or not you believe that principle has any merit.

Considering #1 is likely what those who'd make arguments #2 and #3 would reach for when pressed to explain what makes it virtuous/why the principle has merit (and because it's the argument I'd make), I 'll go with that. While it's true that it hurts those who are traumatized by 9/11 (be it directly by surviving the attacks, secondarily by surviving someone who sadly did not, or just from watching it on TV), it's also true that there are others who have sublimated their trauma into a fucked up sense of humor. They would be able to laugh - indeed, they need to laugh about it to cope. And of course, some people aren't traumatized anymore! Some wounds heal! People get over things, and they *can* laugh. Not to mention all the people who were never traumatized in the first place, and so could always find humor in it.

Being able to find humor in things is good! It's good for things to be "funny"! "Funny" means a thing inspired... happiness? Joy? Glee? I don't know if there's a word that actually captures the emotion I feel when I find something "funny". It's a positive emotion but (to me, at the moment) that emotion feels to happiness/joy/glee like what anger is to sadness (fundamentally different in some way).

Really though, it's funny for me because I'd have to actively think about all the pain and anxiety the attacks caused people for it to stop "being funny" (which in this context means being able to find humor in aspects of a thing, and not "it is hilarious in its totality. people jumping to their deaths to escape the flames? lmao!"). Doing that would make me feel bad. Wanting to inspire negative emotions is bad. Evil. Why do you want me to be upset about something I'm not upset about? Why do you demand I experience that pain? Who does it help? I know who it harms: everyone who'd have laughed at a joke I didn't tell because I was too busy dwelling on the terror of an imaginary 9/11 victim. (I don't know any personally, so they are going to have to be imaginary.)

How is it that the people who say "You mustn't feel any positive emotions when dealing with this subject! I'd prefer that you dwell on the misery of others and feel miserable if the alternative to that is you feeling something positive in spite of my sacred pain!" are the good guys, and the folks who say "Let go of your pain and laugh with me! I want you to be able to extract a sliver of happiness even in spite of the great misery you have experienced/witnessed!" are supposedly the evil one?

Inspiring good feelings is good, btw. Just like inspiring bad feelings is bad. Wanting to make a tragic thing funny means wanting to make the bad become the good. It means wanting to redeem it. Jesus would laugh at The Life of Brian for redeeming the tragedy of His crucifixion, and weep at The Passion of the Christ.

My friend was with his plug (I won't say my plug, because I go through my friend to get to him everytime and he don't speak good English or good Spanish and I don't speak any creole)

So my friend used the plugs knife at some point to cut something, product, a string, whatever he used dude's pocket knife to cut something while they were hanging out.

Someone got stabbed a week ago last friday with that knife. My plug isn't in the system for DNA or finger prints, clean record, my boy is a convicted felon.

So i guess they pulled DNA from skin cells in a manner called trace DNA on the handle of the knife, my plug disappeared (it's a homicide investigation) and they arrested my friend, the proof

He has no alibi (cuz he's fucking off drunk as shit, selling drugs and hanging out with some cool ass niggas who won't respond to a police inquery), has priors for violence (but no weapons/no homicide serious shit), but his trace DNA (along with a bajillion others) was on the knife inside the handle. He told me today, thatit's one of those fold out where it's got hollow spaces to fit all your skin cells in apparently.

So they got 2 things the state are really focusing on, his hand skin cells, he doesn't know how that knife ended up int he victim, he doesn't remember who owned the knife, and the victims blood is all over the handle.

I don't know the victim but I know he wasn't very good at surviving five stab wounds to the chest lol

So I try to call him (since I kinda wanna get a fatass bag of weed cuz it's the day time (my favorite time to smoke weed, other than at night) and figured i'd explain what's up kinda) I have a friend who speaks creole, spanish, french, English and Russian, I use him for anything serious a lot, when he told me how many languages he knew, I said DAMN NIGGA HOW MANY DADS YOU GOT?

So anyway, i ask him to help me call my plug and he says yea sure five minutes i gotta wrap something up and shows up two hours later. My plugs phones disconnected.

They put my boys bail at 500 for Second Degree Homicide, in florida you need to put up 10%, he aint got not 50k bruh, he aint got 5k.

And what he supposed to do? Finger one of the crazier motherfuckers as the murderer, get out immediately and go to 8 funerals (including your own last) in the next year while dude throws his massive balls, money, and he's part of a gang known for this type of behavior, or face 20 years in a prison without air conditioning when it's 110 degrees out at 32 w/ two kids.

Police: "Where were you at 4:22am on Thursday two weeks ago?"

Amgio: "sleeping in my bed with my wife."

    "Can anyone verify that?"

    "My wife."

"she will lie for you always."

    "My kids?"

"Your kids were awake at four thirty in the morning on a week day?"

    "Well no, but before."

    'So you have no alibi?"

That's where he is at, he asked me to show his wife how to set up video visits, put money on his books, asked me not to fuck her for some reason kinda weird but like 2/3 through the phone call he just said don't fuck my wife :/ I"m like okay lol

And uh yeah so he's probably getting out pretty soon like next Nevuary Never Third.

Why did he waive his rights and answer questions?

What kind of knife? Just curious. It's a bad description.

They would probably drop the charges after a year or two. He should probably stfu at some point though.

Oan idk how all the DNA stuff works but I'm pretty sure there's such a thing as contamination regardless if the other guys was on file. So that's probably weak.
