They can, the age of consent is set as a blanket ban to protect the late developers. kids develop at different rates and the state understands that, but they also understand they cannot possibly assess every child on an individual basis so they set it toward the higher age group to protect all children. If protecting children was an ethic you possessed then you'd observe that law gladly. The fact you don't shows you don't give a shit about your victims.
