   It's silly, yes, but prostitution laws are hardly even enforced. It's neither politically tenable to legalize prostitution nor illegalize porn so the US at least has more or less defaulted to de facto legalization of the former.
   
   If you want to take a more cynical approach, prostitution doesn't have significant social utility, to a degree it threatens traditional family structures if access to sex isn't contingent on monogamous long-term relationships. Pornography doesn't pose the same threat, it doesn't replace a sex life satisfyingly enough to endanger the material economy built up around courtship.

    Just tell the whore that you want to pay them to take nude photos. Obviously a cop isn't going to agree to that, and a whore will take the easy money nine times out of ten. When they agree, tell them you're just trying to fuck. Pornography requires more than just a camera, namely a license and documentation of age, proof of consent, and image release waivers for all performers.

    A few huge problems with prostitution are human trafficking and child exploitation. Legal pornography requires licensure as well as meticulous CYA records.

    As would legal prostitution, as soon as you need to issue tax documents human trafficking becomes infeasible.

    Indeed but Europe, The Netherlands in particular, still has a huge problem with human trafficking from Eastern Europe and Russia.
