It always strikes me as interesting that people who are into postmodern approaches to sociology race to deem the most controversial things social constructs yet when faced with the consent, something that's immediately obvious as a social construct, it's treated like some kind of natural law where it's somehow perfectly clear what it is to the point it can be gleefully litigated on. I don't know if that describes you or not, but I think it's an interesting conflict within what I would call the prevailing societal view.

That's exactly what the argument is. By not being able to give consent it would definitely have a negative impact on them.
In the cases you were comparing it to, the adults are accepting responsibility for their actions. Homosexuals can make that choice. People of different races can make that choice. Children cannot. -
