    Dominion hits conservative networks, Trump ally with $1.6 billion defamation suits


    Dominion Voting Systems on Tuesday morning filed three $1.6 billion defamation lawsuits against two pro-Trump media networks and an outspoken Trump ally, the latest in a string of suits from the company against those it says pushed false accusations that the company helped rig the 2020 election.

    The complaints were filed against Newsmax and One America News Network, as well as against former Overstock CEO Patrick Byrne, who is an outspoken supporter of the former president.

    Newsmax and OAN "helped create and cultivate an alternate reality where up is down, pigs have wings, and Dominion engaged in a colossal fraud to steal the presidency from Donald Trump by rigging the vote," Dominion wrote in each of its complaints against the two networks.

    Specifically, Dominion alleges that the two networks "manufactured, endorsed, repeated, and broadcast a series of verifiably false yet devastating lies about Dominion." OAN, they allege, was motivated by a "quest for profits and viewers" in competition with leading conservative network Fox News. They say both outlets helped spread these lies by promoting other figures such as Byrne, who they say "pushed lies" in collaboration with "other Trump-connected individuals.

    "Byrne continues to stick to his manufactured, inherently improbable, profitable, and demonstrable lies," the complaint against him says.

    The complaints include dozens of statements by the networks and Byrne repeating conspiracy theories about the company, and claiming "evidence" to back them up.

    A Newsmax spokesperson said in a statement, "While Newsmax has not reviewed the Dominion filing, in its coverage of the 2020 Presidential elections, Newsmax simply reported on allegations made by well-known public figures, including the President, his advisors and members of Congress -- Dominion’s action today is a clear attempt to squelch such reporting and undermine a free press."

    Earlier this year, however, Newsmax retracted some its reporting surrounding the 2020 election as part of a settlement after it was sued by a Dominion employee last year. Referring to allegations that Dominion had schemed to rig the election in favor of President Joe Biden, the network reported that it "subsequently found no evidence that such allegations were true."

    OAN and Byrne did not immediately respond to ABC News' request for comment.

    Dominion's latest complaints were filed in Delaware by the Denver-based voting company, which became the subject of false far-reaching conspiracy theories fueled largely by right-wing figures close to then-President Donald Trump as part of efforts to overturn the results of the election

    Dominion has in recent months filed similar billion-dollar defamation suits against other Trump allies for what the company said was their role in pushing the false allegations, including Rudy Giuliani, Trump's personal attorney; Sidney Powell, a member of the Trump's legal team who was later removed; and Mike Lindell, the Trump-aligned pillow magnate.

    All of those parties have denied the allegations against them and have asked a judge to dismiss the lawsuits. Those motions are still pending.

    The litigation comes amid a wave of renewed scrutiny of the 2020 election results, as Democrats in Congress have ramped up their investigation into the storming of the Capitol on Jan. 6 by Trump supporters who believed the election was tainted by fraud, while Republicans in some states have renewed calls for additional audits of the 2020 returns.

    After pushing baseless allegations of election fraud, Byrne was one of the key figures who helped fund a partisan audit of the 2020 election in Arizona's Maricopa County, ABC News has previously reported.

    Byrne, who previously said he'd been funding his own team of "hackers and cybersleuths and other people with odd skills" to search for voter fraud, has so far raised over $1.5 million to support the audit, according to the website created by his new nonprofit organization, The America Project. The former CEO also claims to have donated at least $500,000 of his own money to fund the audit.

    Wisconsin governor vetoes slew of GOP voter reforms

    Wisconsin's Democratic Gov. Tony Evers vetoed several pieces of legislation aimed at reforming absentee voting laws passed by the state Legislature on Tuesday.

    The bills would have imposed new restrictions on absentee voter registration, including an ID requirement and a limitation on the collection of absentee ballots more than two weeks out from an election.

    "Across the country the right to vote is under attack," Evers wrote on Twitter. "But here in Wisconsin, I’m making sure we keep elections fair, secure, and accessible by vetoing a series of GOP bills that attack the heart of our democratic process."

    "The right of everyone to vote in our elections isn’t partisan, it’s a fundamental right that we have to protect," the governor continued. "Wisconsin Republicans are determined to take away the right to vote and tilt the scales in their favor."

    The governor's veto was expected after the bills were passed without a single Democratic vote of support and early indications from Evers that he intended to strike the legislation down.

    “The goal is to make sure that every single person has the chance to vote,” Assembly Speaker Robin Vos, a Republican, said of the legislation before the veto. “But that we guarantee that the [lack of] confidence in the election, which was severely undermined by the actions of a few over the last election cycle, is a thing of the past.”

    Republicans in the Wisconsin Legislature do not have the required number of votes to overturn the veto, leaving the reforms dead in the water.

    The governor also said that two counties in the state that have been subpoenaed for ballot and voting machine information should refuse to turn over the materials, according to the Associated Press. Evers compared the subpoena to the election investigations in Arizona, calling the situation "a clown show."

    Wisconsin has been a consistent target for Republican leaders aiming to overturn the 2020 presidential election results. Trump lost in Wisconsin to President Joe Biden by more than 20,000 votes after winning the state in 2016.

    “They are actively trying to prevent a Forensic Audit of the election results, especially those which took place in Milwaukee, one of the most corrupt election locales in the country,” Trump said in June.

    Many Republican leaders in Wisconsin have distanced themselves from the unsubstantiated claims of election fraud.

    As Wisconsin Gov. Tony Evers struck down six Republican-backed measures that he said would have made it harder for residents to vote, the Democrat had a sharp message for those who continue to undermine the 2020 election results:

    "Since November 2020, we've watched Republican governors and legislators around the country work quickly to add more hurdles to voting, to discredit the good work of our election officials, and to try and cast doubt on an election just because they didn't win. They're trying to stack the deck so they get the results they want next time, and they're trying to make it harder for every eligible person to cast their ballot."

    Citing his own narrow 2018 victory over then-Gov. Scott Walker, who conceded after a contentious election, Evers said Republicans need to tell their constituents the truth about President Joe Biden's win.

    "Now it's time for those who stirred the pot to say there's nothing there," Evers said.

    Wisconsin has already extensively assessed its 2020 election results, when Biden's victory was affirmed by recounts in two of the most populous counties. The Associated Press, citing documents obtained under a public records request, reported in May that Wisconsin election officials had identified and forwarded to prosecutors just 27 cases of potential voter fraud in a state where 3.3 million ballots were cast in November's election.

    Evers clearly relished the executive actions on Tuesday, remarking as he signed the sixth and final veto, "And here's the final nail in the coffin," to the cameras gathered around him. Wisconsin Republicans do not have enough votes to override his vetoes.

    But the efforts to re-litigate the 2020 election in Wisconsin are not over. Two Republican-led measures to review the 2020 election results are underway, while one GOP lawmaker on the Assembly Elections Committee even attempted to seize ballots and voting machines in two counties and issue subpoenas to county clerks for ballots, according to the Milwaukee Journal Sentinel. When asked whether the clerks should comply with the subpoenas, Evers was direct: "The answer would be: 'Hell no.'"

    Similar efforts to audit the 2020 election results have produced no proof of fraud, as some claim. In Michigan, the GOP-led state Senate found "no evidence of widespread or systematic fraud," and recommended the state attorney general consider investigating individuals who pushed false claims "to raise money or publicity for their own ends." Arizona's review of ballots cast in Maricopa County has been widely derided. The Republican chairman of the Maricopa County's Board of Supervisors even accused the state Senate of "running a grift disguised as an audit" and has called the contractors it hired incompetent.

    "You've seen what's happening in Arizona," Evers said Tuesday, "it's a clown show."

    The Point: For Wisconsin, these executive actions are a big step. But as long as the state's Republicans continue to question the 2020 results and push to make voting access more difficult, like in many other states, this fight won't be over anytime soon.
