    Trump's Facebook ban upheld by Oversight Board

    Facebook was justified in banning then-President Donald Trump from its platform after the Jan. 6 riot at the U.S. Capitol but will need to reassess how long the ban will remain in effect, the social network’s quasi-independent Oversight Board said Wednesday.

    The decision is a blow to Trump's hopes to post again to Facebook or Instagram any time soon, but it also opens the door to him eventually returning.

    Facebook created the Oversight Board last year as a kind of "supreme court" to hear appeals from users like Trump who have had their posts removed or who want to challenge other sensitive or contentious moderation decisions. The decisions of the 20-member globe-spanning board are not binding, but Facebook CEO Mark Zuckerberg has pledged to abide by what it says.

    “Given the seriousness of the violations and the ongoing risk of violence, Facebook was justified in suspending Mr. Trump’s accounts on January 6 and extending that suspension on January 7,” the board said in its decision.

    The oversight board said, though, it was not appropriate for Facebook to vary from its normal penalties when it made the ban indefinite. Facebook’s normal penalties include removing posts, imposing a limited suspension or permanently disabling an account, the board said.

    “As Facebook suspended Mr. Trump’s accounts ‘indefinitely,’ the company must reassess this penalty,” the board said.

    Here's the big tell on the real reason Republican leaders want to dump Liz Cheney
    Analysis by Chris Cillizza, CNN Editor-at-large


    Two things have become very, very clear over the last 24 hours:

    1. Wyoming Rep. Liz Cheney is likely to be removed as the third-ranking Republican in House leadership -- as soon as next week when the House reconvenes.

    2. New York Rep. Elise Stefanik is the preferred replacement for Cheney in leadership, with House Minority Whip Steve Scalise (Louisiana) now publicly supporting the Cheney-for-Stefanik swap.

    These two developments are quite clearly related -- and revealing.

    House Majority Leader Kevin McCarthy (California) has said that the reason Cheney appears to be on her way out is because she isn't the best policy messenger for the party. Which, as I noted on Tuesday, is totally ridiculous, since Cheney is a consistent conservative on everything but her willingness to speak out against former President Donald Trump and her vote to impeach him for his role in the January 6 riot at the US Capitol.

    The move to sub Stefanik in to replace Cheney is yet more proof of what's really going on here. Stefanik, who was elected to a fourth term from an upstate New York seat, has seen her star rise directly in concert with her ardent public defense of Trump during both of his impeachment trials.

    Stefanik first came to the attention of Trump (and his allies) with her interrogation of witnesses during the House Intelligence Committee hearings over Trump's possible quid pro quo in Ukraine. That won Stefanik a place as part of Trump's PR efforts during the Senate trial.

    Trump singled Stefanik out for praise at the White House in February 2020. "I was up campaigning for helping her and I thought, 'She looks good, she looks like good talent,'" the President said in a speech celebrating his acquittal by the Senate. "But I did not realize when she opens that mouth, you were killing them, Elise, you were killing them.

    And, Stefanik -- contra Cheney -- opposed the second impeachment of Trump earlier this year for his role in the January 6 insurrection. "It is a partisan ploy with no basis in the Constitution," Stefanik wrote in explaining her vote. "The Democrats' decision to impeach the President with one week remaining in his term further fuels the divisions in the country during this very trying time."

    What's remarkable about all of this is how incredibly transparent all of this is.

    CNN's Gabby Orr reported Wednesday morning that McCarthy and Trump have been in regular touch about the fight over Cheney. "They've definitely spoken recently ... within the last couple of days for sure," Trump aide Jason MIller said via text.

    This is Trump as puppeteer, with McCarthy and Scalise dancing to his preferred tune. Still don't believe me? Check this out: According to the conservative Heritage Action group, Cheney's lifetime vote score is 80%. Stefanik's is 48%. And even when it comes to votes in support of Trump, calculations done by 538 show that Cheney voted with the former president 92.9% of the time while Stefanik backed him 77.7% of the time.

    So, yeah. This isn't about conservatism. Or even, really, supporting Trump's agenda while in office. This is about Cheney drawing a line in the sand over the events of January 6, as well as the runup to that day and its aftermath, all centered on Trump arguing, contra all available evidence, that the 2020 election was stolen. And yes, Stefanik voted to object to the Electoral College count in Pennsylvania on the same day that the Capitol was overrun by Trump-inspired rioters.

    If you needed any more evidence that the Republican Party is currently a cult of personality around Trump, the fall of Cheney and rise of Stefanik should help convince you.

    Trump Lawyers, of All People, Demand Enemies Pay for 'Weaponizing Courts'

    Former President Donald Trump’s lawyers are asking a federal court to make Democrats pay. Literally.

    On Monday, the ex-president’s attorneys sent a new motion to the legal team representing Democratic Rep. Bennie Thompson and the NAACP in a lawsuit that alleges Trump conspired to incite the U.S. Capitol riot on Jan. 6 and disrupt the Electoral College vote count, according to three people familiar with the document. Trump’s attorneys contend that the plaintiffs brought a “frivolous” suit against the twice-impeached former president, and argue that a federal judge should sanction the opposing side.

    In the motion, a copy of which was reviewed by The Daily Beast on Tuesday, Trump attorney Jesse Binnall argues that the lawsuit represents an attempt to “weaponize the federal court system in a political dispute” and use the courts to regulate “political speech.” As a result, Trump’s legal team says that Thompson, the 10 members of Congress who signed onto the suit, and their attorneys “should be ordered to pay President Trump’s fees and costs reasonably incurred in defending against this frivolous lawsuit and for such other sanctions as this Court finds just and reasonable.”

    Binnall, Trump’s attorney for Jan. 6 riot-related lawsuits, declined to comment on this story. A spokesperson for the plaintiffs’ attorneys declined to comment, as well.

    The motion mirrors former President Trump’s impeachment defense and argues that Trump’s rhetoric in the runup to the Jan. 6 riot amounted to constitutionally protected political speech. It further contends Democrats engaged in similar rhetorical flourishes, and that those pressing the case against Trump would be open to similar suits for their own rhetorical excesses, should the suit prevail.

    Among the others supposedly open to liability, Binnall claims that House Speaker Nancy Pelosi encouraged “an insurrection by left-wing demonstrators who raided the Hart Senate Office Building on October 4, 2018, to obstruct the Senate’s confirmation of Justice Kavanaugh.”

    Capitol Police charged roughly 300 protesters with "crowding, obstructing or incommoding" during a protest against Brett Kavanaugh’s Supreme Court nomination hearings as demonstrators organized by the Women’s March chanted “Hey, hey, ho, ho — Kavanaugh has got to go."

    No injuries were reported.

    The new motion pays particular attention to Rep. Maxine Waters, a favorite target of the former president and a plaintiff in the Thompson suit. As The Daily Beast reported last week, Trump himself had recently told his advisers he wanted attacks on Waters to be heavily factored into the legal and messaging pushback against riot-related litigation.

    Binnall argues that Waters “actively encouraged rioters and violence” and cites comments made by the California Congresswoman that protesters need to “get more confrontational” if convicted killer Derek Chauvin was not found guilty in the murder of Floyd and a 2018 speech in which she encouraged supporters to confront Trump administration staff and tell them “they’re not welcome anymore, anywhere.”

    Spokespeople for Pelosi and Waters did not respond to requests for comment. Rep. Thompson, the original plaintiff in the case, remains undeterred, according to a spokesperson.

    “For reasons that we will explain in our filing in court, Mr. Trump cannot rely on the First Amendment to shield his unlawful conduct or to avoid being held accountable for it,” a Thompson spokesperson told The Daily Beast on Tuesday.
