If it was "illegal" could they still've gotten married and just taken the punishment? Or would the person with marriage authority who...tried to marry them get in trouble and the marraige be void?

I'm not familiar with the exact letter of the law, but my understanding was that the marriage would not be sanctioned by the state or the Church. While there have been 'rogue' marriages in the past (notably between slaves), the formal union that gays sought was to be recognized within a legal context. This translates to problems of a more practical variety: joint property ownership, health insurance policies, etc. which cannot be shared without a valid marriage.
