I told you in the other thread, look up the FLSA. This is a federal law which trumps TX law, not that TX probably has anything on the books to refute.
If min wage is 5/h but you make 2.50 because tips, and come out with 7/h after 1h of work, THATS OKAY. But if you make only 4.50/h your boss has to comp you the 50 cents so that you're making at least minimum wage.
Any time you make less, you need to inform your boss and they legally have to pay you up to min wage no matter which of the 50 states you're in.

Bill Krozby point is that you dont have to hire a server at the normal minimum wage, which is true, and your point is that an employer will always be required to pay a server the actual minimum wage if ever there tips dont cover it (which rarely ever fucking happens.)
It gets a little tricky because it's not hourly, persay, like in your example. An employer obviously wouldn't know what their server is making each individual hour by hour, and so it's not like a server who works a full shift and makes $150 in tips is still going to be compensated for the 2 hours of work they did in the afternoon where they didnt make any tips.
This is also why many times, tipped employees paychecks can be pretty small, even if they worked full time hours. All the taxes from their wages plus (what's supposed to be accurately reported) tips are just taken out of their paycheck obviously since they cant take back cash money the person already has made in tips. In essence, the more you make in tips, assuming you're reporting them, the less your check is gonna be.
Servers will complain about this sometimes like "you have no idea what it's like! Sometimes our paychecks are next to nothing!" Yet they dont realize that I realize that what that means is they killed it in tips, and a smaller check for them is actually a reflection of how much money they're actually making.
