But yes, that would allow the Army and Air Force to do it as well. Two different lines of thinking with the word expressly; those who believe (a) that it means it would never be applicable since COTUS has no wording allowing it, and (b) those who believe the word is useless and must be ignored since it represents an illegal overreach of power from Legislative on Executive. It would ultimately come down to Judicial to decide and SCOTUS is on Executive side right now. -
