    Pretty sure you don't have to be a citizen to have the constitution apply, mostly because the constitution doesn't deal with citizens so much as limiting the power of the state.

    It's in the very first line of the United States Constitution: "We the People of the United States...". Everything contained thereafter applies to only "We the People of the United States". It doesn't say, "They the People of Iraq", or "They the People of Somalia". Only people of the United States enjoy the rights and privileges and protections of the Constitution. That's the law.

    Every federal ruling on the matter states otherwise. You can't just pull out the parts of the constitution you think would work for you.

    But the prohibitions in the constitution are generally upon the powers of the state rather than grants of rights to "the people". E.g. the state may not pass a law establishing or prohibiting religion. It doesn't say "the state may not make laws establishing or prohibiting religion of citizens, but when it comes to aliens then go for it", the state simply can not pass legislation on religion at all.

    Also §m£ÂgØL is right that case law is decidedly against you here.
