"Prove that they are underage." That should be the staple of the sea pea defense.
An investigator is the one who makes the determination and presents expert testimony. "Expert" being something of a technical term, they just look at the pictures and make a judgement call. Typically though police and prosecutors don't want to get into ambiguous cases and if there's reasonable doubt they won't pursue it.
Also if it's illegal or not depends on who has jurisdiction over a person. So for legality of content on the site that means US law because I live and host content in the US. If my servers were in Russia I'm still obligated to obey US law, although the US law enforcement may be unable to take direct action to take content down if it doesn't violate Russian law. -

i noticed a bit of a contradiction a while ago. while in jail there was news reports about the french closing the calais immigration camp, i think they called it the jungle or summing. anyway britain agreed to allow any of the under 18s immigrants to come to the UK. but there was a big hoohaa about how a lot of these refugees were over 18 and just pretending they were minors just to get a free pass to live in the UK. none of them had proper identification and it was impossible to check up their identities with their home countries. i remember some 'so called experts' were coming on tv saying they can tell fairly accurately if somebody is over or under 18 by something to do with fucking ears and jaws or some shit. but many other experts disagreed and said that is no foolproof method and there is in fact no way to tell with any degree of accuracy, as different people develop physically at different rates. so if its impossible to tell if somebody is over or under age when examining them in the flesh, then how the fuck can you make that kind of a judgment with any degree of accuracy just from looking at a photograph?
considering this fact, that shouldn't qualify as evidence in a court of law, as it is nothing more than assumption and conjecture on the part of the pigs who have a biased initiative toward anything that will help to build a case against a so called 'suspect'.

Well again, there is a big gray area but there's also some cases that fall clearly on one side or the other. We can imagine a 15 year old looking 18 or vice versa but cases with that kind of ambiguity don't typically go to court. Any reasonable person could identify a 10 year old as a minor. -

this is the thing tho, i don't trust pigs and prosecutors to not exaggerate because i know full well they will and do when it suits them. and like somebody said nobody gets to see the pix that these people get charged with so how do we know they were of 10 or 12 year olds? we've literally only got the pigs word on it and their word ain't worth shit. it would be so easy and tempting for them to lie or exaggerate when they are also aware of the fact that nobody is going to see those pix either, and so be able to challenge them and bring them to account for their deviousness. its also a fact that the moment a dude is charged with possessing those sorts of pix, nobody listens or is prepared to believe a word they say. i seriously wonder how many of those cases are actually innocent people being stitched up by the cops. and don't say they wouldn't do such a thing because history will prove you so very wrong on that account.
its like i said the other week. 30 or 40 years ago, if you wanted to character assassinate someone you would make out they were either gay, a drug user or having an affair, maybe something kinky if you really wanted to go to town on them. now a days nobody gives a shit about that stuff. if you want to character assassinate somebody now then the only choices you have is pedo/sex offender or some kind of terrorist affiliation.
