Collections trying to collect on a fraudulent debt. What do I do?

    The other day I recieved a letter in the mail saying I owed my old landlord $426 dollars and it was from a collection agency trying to collect it.
    I called my old landlord to ask them why they never sent me a bill and during the call (which I recorded) my landlord stated that she did have my forwarding address and contact information but never sent me a bill as it wasn't her job...
    Then she proceeded to describe over the phone a list of charges that she claimed to be the reason why I still owed money.
    After that call I contacted the collection agent who is a real ugly, obnoxious black woman who basically told me that if I don't pay it they will report it to the credit reporting whatevers.
    I asked what proof they had of my supposed debt and she e-mailed me a 1 year lease from October of 2020 that expires September 30 2021
    The lease is in both Michelle's name and my name and yes they have been trying to collect this from her as well.
    Keep in mine that this bill is dated 6/6/2022



    After Michelle and I broke up she moved out and I resigned a new lease after the 1st one expired.
    The new lease was in my name only and so should this debt as I see it.
    Except that no where in the lease do I see anything about a lease break fee of $58.
    And also the month of rent they are charging me for that is 2 months after I moved out and returned my keys has pet rent included which makes no sense as if I'm not living there anymore why the hell are they collecting pet rent still too...
    There was no drywall damage but there was a spot of peeled paint yet the description my old landlord gave me doesn't match that. She said they had to replace drywall.

    In Ohio a landlord has 30 days to return a tenants security deposit or give explanation as to why they haven't and neither of those conditions were met.
    I am in my right to take my old landlord to small claims court for double my security deposit which I never bothered doing before because it really wasn't worth my time but now that they are selling fraudulent debt to collection agencies to harass me about I think I might go ahead and pay the $75 filing fee to take them to court.

    According to that bill my move out date was 5/2/2022 which is also incorrect as I moved out around 4/20 but the bill is dated 6/6 which is past the 30 day mark anyways so I am 100% in my right to go after them and I feel as though I should to resolve this case.

    What do you think I should do?

    If you’re planning on going to court you need evidence:
    A copy of the lease signed by you & the landlord
    Copies of canceled checks, bank statements and/or proof you paid rent for the months they’re claiming you didn’t
    Pictures of the apt the way you left it (dated) if you did a walk through with the landlord (also required) then bring that signed document
    Proof you moved everything out on 4/20 (lol btw)

    Courts don’t accept “your word” they require tangible evidence for every claim your asserting.
    No hearsay either….


    Scummy bastard slum lord charging $110 cleaning fee…I’d request proof of that

    If you win your claim I think the landlord will have to also reimburse your filing fees.

    Don't communicate with collection agencies seems to be common advice.

    Most will settle for 40% or so after a while...but never give them your bank details send them a check after they send you a letter stating agreement to the settlement.

    Or wait 7 yrs for it to disappear off your credit record...never make a payment though as that resets the 7 yrs...unless again, you negotiate a settlement agreement (even then it stays on your record so you're better off just letting it expire after the 7yrs).


    There's a whole thing about asking the collection agency to provide a detailed copy of the original receipt/debt and them being unable to because they don't have it (they bought the debt)...at which point you can demand they remove it from your credit record.

    He posted a legal document stating when he left, all he has to prove is that he did in fact leave.

    which can be easily proved by showing them any documents he signed on another lease.

    7 years huh? Fuck I would have to really struggle to remember and look at a calendar but if thats also true in my country I might be in way less debt than I thought. I just assumed they hound you FOREVER AND EVER AND EVER

    Same with foreclosures I think

    Fona, you got the house (which is the big thing) and usually pay cash for your cars right?...I wouldn't worry about it, you're young so just let it fall off in 7yrs...it will pass quickly.

    Sure you can fight it but that's a lot of stress and PITA if you don't really need to use your credit for big purchases (like a house or car)

    You'd need pictures of the apartment and to go over the copy of your lease agreement. Youre leaving out a lot of details. you resigned a lease agreement at the same at the same apt you and shell were in?

    I'd just tell them to fuck off. Only reason I can think of where your credit score may come into play is if you in the near future want to refinance your house to a lower rate.

    My landlord is now counter suing me and has submitted an altered disposition dated June 1st.

    How do I submit an e-mail with an attachment as evidence in court?

    Dont worry. Ill work on this as your attorny. I called them but they were closed today(Sunday) but I left a message under the "emergency maintainence" area and said I was Andrew Steele and that not paying them. I also called them faggots.

    I call them tommorow and introduce myself as your attorny and Ill say Im from "The Attorny Office of Harris And White" or something. Ill try to sweet talk them into dropping the bill and if that doesnt work and threaten bad reviews and stuff.

    Please send the contact info for the collection agency so I can contact them as well.
