These are proposed measures and they include a fine, and the article even lists the amount. Its a misdemeanor. Most people wouldn't be put in prison for this.
The prison sentences are existing law for extreme cases. Like that dude in FL or whatever who got arrested for simply 'collecting rainwater' but then it turned out he had massive amounts of it and had diverted the waterflow away from a nearby river.
That kind of action should not be punishable by a mere fine or misdemeanor in a time where rations are needed. -
