I think in the 1700 or 1800s a person could shoot someone to stand your ground but not if the person flees unless they're kidnappers with your kid being pulled away and you had a safe shot.
But the way he said it, sounds like she begged him and a moment of time occured where he was not in a threaten position or on threaten grounds anymore (so many states, even during the wild west 1800s would try him for manslaughter).
