   In that environment if a private security guard detained someone who had stole less than $900.00 the fairs could possibly be charged with assault, unlawful detainment, and be sued by the perp for violation of his civil rights.

   Well no, that might be the case under CURRENT law...again that dynamic can change. If the gov don't want to enforce then they get no say in how that enforcement is laid down.
