    Rep. Eric Swalwell (D-CA) has filed a lawsuit against former president Donald Trump, his son Donald Trump Jr., Rudy Giuliani and Rep. Mo Brooks (R-AL) accusing them of inciting the storming of the U.S. Capitol on January 6.

    In a statement, Swalwell said he filed the civil claim against them for "inciting an attack against the Capitol that terrorized lawmakers and prevented us from doing our jobs of certifying the votes of the American people."

    His statement said that the events of January 6 came as a "direct and foreseeable consequence of the Defendants' false and incendiary allegations of fraud and theft."

    Today, I filed a civil claim against Donald Trump, Donald Trump Jr., Rudolph Giuliani, and Rep. Mo Brooks for inciting an attack against the Capitol that terrorized lawmakers and prevented us from certifying the votes of the American people.

    "The Defendants assembled, inflamed and incited the mob, and as such are wholly responsible for the injury and destruction that followed."

    The move comes after Trump was impeached following the events of January 6. It made him the first president to be impeached twice.

    However, he was acquitted at his Senate trial. Swalwell was one of the House impeachment managers who argued against Trump.

    Newsweek has attempted to reach representatives of the defendants for comment.

    WSJ Hits Back at Trump, Says Former President Should Get ‘Counseling’

    The Wall Street Journal is hitting back at an attack from former President Donald Trump.

    In a piece late Thursday, the Journal’s editorial board responded to a lengthy statement by Trump bashing them as an outlet which “nobody cares about,” and which has “lost great credibility.”

    “For someone who says we don’t matter, he sure spends a lot of time reading and responding to us,” the editorial board wrote. “Thanks for the attention.”

    The Journal’s editorial board believes its critique that Trump is responsible for the senate defeats in Georgia hit home with the former president, because it’s further indication that he should not be the standard-bearer for the party going forward.

    “In the single Trump term, Republicans lost the House, White House and finally the Senate,” they wrote. “How can it be that everyone other than the most prominent Republican in the country is responsible for victories but not the defeats that have left Republicans in the wilderness?”

    The Trump team, for its part, believes the Journal has a vendetta against the former president. In a soon-to-be-released edition of Mediaite’s weekly podcast The Interview, former Trump campaign adviser Jason Miller pointed out the Journal’s consistent opposition.

    “They’ve been hitting President Trump — if not once a day — then twice a day pretty continually for about a week now,” Miller said. “And I think the president wanted to push back there, and point out that, ideologically, this isn’t just a NeverTrump positioning for the editorial page for the Wall Street Journal, there’s a never-populist effort.

    But the Journal argues it is the former president who has the unhealthy fixation.

    “Losing to Joe Biden of all people, and by 7.1 million votes as an incumbent President, must be painful,” the editorial board wrote. “Counseling could be in order.”

    Former President Trump, his eldest son and several of his allies were sued on Friday by Rep. Eric Swalwell (D-Calif.) over their role in the run-up to the Jan. 6 breach of the U.S. Capitol.

    The 65-page complaint filed in federal court in Washington, D.C., accuses Trump, his son Donald Trump Jr., Rep. Mo Brooks (R-Ala.) and Trump lawyer Rudy Giuliani of inciting the riot and violating a number of federal and D.C. laws.

    Each defendant was among the speakers at a pro-Trump rally that immediately preceded the deadly Capitol breach. The lawsuit depicts the incendiary rally speeches as a tipping point that culminated a months-long disinformation campaign to push the false claim that the 2020 presidential election was stolen from Trump.

    "The horrific events of January 6 were a direct and foreseeable consequence of the Defendants' unlawful actions," the complaint states. "As such, the Defendants are responsible for the injury and destruction that followed."

    The lawsuit seeks unspecified money damages and asks for a court order requiring Trump and his allies to provide at least a week's notice before holding any future rally in D.C. related to an election.

    Among the allegations contained in the nine-count complaint is that defendants conspired to prevent lawmakers and then-Vice President Mike Pence from certifying President Biden and Vice President Kamala Harris's election win, in violation of a federal civil rights law.

    Attempts to reach Trump, Brooks and Giuliani for comment were not successful.

    The lawsuit is the latest instance of potential legal exposure for the former president. Trump also faces a criminal probe in Georgia for pressuring officials to overturn President Joe Biden's electoral win and is under investigation in New York for possible financial crimes and civil violations related to his businesses.

    The Biden administration's Justice Department also faces pressure from progressives and Trump critics to pursue criminal charges against the former president.

    Swalwell's lawsuit comes less than a month after Trump was acquitted in a Senate impeachment trial over his role in the Jan. 6 attack. Swalwell, a former county prosecutor in California, served as one of the House impeachment managers in the Senate trial.
