    Wrong. I perform drug screens all day long. If the employer wants an observed, we do an observed. Men with men, women with women. There are specific reasons for an observed with DOT employees. But, any employer can ask for an observed.

    2. What about the job applicant's rights to privacy, can pre employment drug tests be supervised?

    The US Supreme Court has held that both blood and urine collection are minimally intrusive and not harmful to job applicants when conducted in the right environment (workplace or collection facility) without direct observation by the tester.

    In other words it would be considered an invasion of the candidate's privacy if the employer required a urine sample while other people were in the room watching or the employer insisted on supervising the process

    However some courts have held that if there is a worry about tampering with the sample the employer may be allowed to have one person of the same sex as the candidate present when the sample is given. Other safeguards that may be enforced include listening to an employee urinate and checking the temperature of the urine
    A drug test result may be considered personal health information and there may be restrictions on how and whether such information can be shared.

    Well, I’ve done many observed. I believe that the employee signs an agreement with the employer for observed screening. Again, federal, or DOT have specific indications, as well as the FAA.

    I'm not saying you havent, I'm just telling you what the supreme court has ruled on. Maybe the people you're testing dont know any better, or dont care either way, but it's possible that it would be well within their right to take the test without a person observing their genitalia, for privacy reasons.

    Where I work we also have an occupational medicine side. I’m certified to do urine drug screens, hair drug screens, and breath alcohol tests.
    If a person is observed, the must pull their pants down to above their knees, and pull their shirt up above their waist, then rotate one time. The observer has to see the urine leave the body.

    I’ve had people get really mad when they give me cold/hot urine, and I tell them I can’t take it, and they have to give me another sample 😂
