I've been thinking about this and prosecuting him sets a very dangerous precedent - perhaps that's the intent.
In short - the state abdicated its responsibility to the people by allowing these riots to continue even after they regularly started to descend into arson, property damage and general mayhem and in many cases refused to even prosecute the offenders after the fact.
If the state is unable to protect its people, people must be able to protect themselves and their property.
If the state refuses to enforce the law and actively prosecutes people who attempt to do it in its place, it shows itself as hostile to the people and inherently unwilling to protect their interests. Even flagwavers who feel their country can do no wrong will begin to feel this way when it comes to their neighbourhood.
